LUC Rules MegaMall Out of Compliance.

Today the Land Use Commission (LUC) met on Maui to hear the last arguments over whether the Pi’ilani Promenade conforms with the original light industrial development that was the reason the zoning change from Agricultural to Light Industrial was allowed.

The LUC in a 6-3 vote, rendered an opinion that, no, the megamall was not the same as the plan that was approved in 1995.

What next?

The LUC will decide if the land will revert to Ag zoning.

South Maui Citizens for Responsible Growth, Maui Tomorrow Foundation and Kihei resident Daniel Kanahele brought the legal action asserting that Eclipse Development Group was in violation because their project did not match the approved project.
